TRUSTSOFT TRADEMARK AND ADVERTISING GUIDELINES

GENERAL

All advertising and promotional materials used with respect to TrustSoft Products must be obtained from TrustSoft, or approved by TrustSoft. Please submit your proposed advertising and promotional materials to advertising@trustsoft.com to obtain approvals or comments. Materials not approved within ten (10) days of submission are deemed NOT approved.

These Guidelines are intended to assist you in proper usage of TrustSoft’s trademarks and for compliance with advertising and promotional guidelines.

METHODS OF ADVERTISING AND PROMOTION

TrustSoft allows banner advertising and text links, provided they meet the standards set forth below. Pop-up advertising is discouraged but may be permitted under certain circumstances. TrustSoft does not permit any advertising or promotion of its products using bulk e-mails, and in particular, unsolicited bulk e-mails are strictly prohibited. Please see the Affiliate Agreement for further details.

All advertising and promotional materials must be plainly labeled “advertising,” or it must be clear from the nature of the materials that they are advertising or promotional in nature.

PROHIBITED STATEMENTS

No advertising or promotional materials may state, prior to downloading of the TrustSoft product, that a computer has been scanned or otherwise examined for the presence of spyware or that spyware has been detected, or any other statement that might lead a customer to believe that the program has already performed its function even though it has not been downloaded.

No advertising or promotional materials may make any claim about a TrustSoft program that is not supported by the facts.

Specifically, no such materials may make an unapproved statement about the mechanism by which a program works; state that a program addresses "all" aspects of a particular problem; or state the number of spyware or virus definitions covered by the program.

IMPORTANCE OF TRADEMARKS

TrustSoft’s brands, product names and logos ("TrustSoft trademarks") are extremely valuable because they represent the standards of excellence and consistent quality associated with TrustSoft.

As of 2005, TrustSoft owns the following registered and unregistered trademarks:

  • HISTORYKILL®
  • TRUSTSOFT™
  • BestPopupKiller™
  • PCBugKiller™
  • SCRAM™

Some of these products are under development.

The absence of a name or logo in this list does not constitute a waiver of any and all intellectual property rights that TrustSoft has established in any of its names or logos.

You are not granted any rights in connection with any TrustSoft trademark. TrustSoft reserves all intellectual property rights, including all copyrights and trademark rights.

You may use TrustSoft trademarks to refer to TrustSoft products and services provided you follow these guidelines.

RULES TO FOLLOW

Below are rules about how to reference TrustSoft trademarks in different scenarios.

Proper Use of Trademark Notice Symbol

Put the world on notice that a product name or logo is a trademark, even if it has not been registered.

If a trademark has been registered with the U.S. Patent and Trademark Office in connection with particular goods and/or services, you must use the symbol ® after the trademark, or the longer "Registered in the U.S. Patent and Trademark Office" or "Reg. U.S. Pat. & T.M. Office," when the trademark is used in connection with those goods and/or services. Use the symbol ™ to identify unregistered trademarks used on goods (tangible items and computer software).

Examples:

WRONG: HistoryKill™ software provides an effective solution for erasing your web history, cookies and Temporary Internet Files
RIGHT: HistoryKill® software provides an effective solution for erasing your web history, cookies and Temporary Internet Files

WRONG: BestPopupKiller® software kills annoying pop-ups
RIGHT: BestPopupKiller™ software kills annoying pop-ups

You may not indicate that the trademark is registered until after a notice posted on this website that the trademark has been registered.

There is no need to discard materials carrying the old trademark simply because an unregistered trademark has been registered. However, when you re-order materials or create any new material using the trademark, you must check to see if the formerly unregistered trademark has been registered. Ideally, each time a trademark is used, it should be accompanied by the symbol TM or SM or ® (again, ® is only for registered trademarks). Redundant or repetitive uses of these symbols, however, may appear cluttered, awkward or cumbersome, when used, for example, in the body of a letter or lengthy ad or catalog copy. In such cases of repetitive use, the symbol should be applied the first time the trademark is used in the headline or body copy and whenever the trademark appears by itself, such as in logo form at the end of a page. You should also use the following legend at the end of such materials in small but legible print:

HISOTRYKILL® is registered in the U.S. Patent and Trademark Office, and BestPopUpKiller and PCBugKiller are trademarks, of TrustSoft, Inc. All rights reserved.

Trademark is an Adjective

Always use a generic term or descriptor after the trademark

Examples:

HISTORYKILL® software, SCRAM™ program, TrustSoft™ programs, PCBugKiller™ product

Never refer to a trademark, even in ordinary conversation, as a noun or verb.

Examples:

WRONG: I will historykill my cookies and Temporary Internet Files
RIGHT: I will erase cookies and Temporary Internet Files with HistoryKill® software

Never Use TrustSoft Trademarks in Plural or Possessive Forms

Examples:

WRONG: HistoryKill's special feature stops annoying ads from popping up.
RIGHT: HistoryKill® software stops annoying ads from popping up.

Set Trademark Apart From Other Words and Use It Consistently

Trademarks should either be CAPITALIZED completely or used with "Initial Caps" in quotes, or at the very least used with Initial Caps. You may also distinguish the trademark with italic, boldface or different colored type.

Examples:

WRONG: Historykill software or historykill
RIGHT: HistoryKill® or HISTORYKILL or HistoryKill

Never mutilate, shorten, abbreviate, or create acronyms out of TrustSoft trademarks. Use trademark as consistently as possible.

Examples:

WRONG: HistKill or History Kill or PopUpKiller
RIGHT: HistoryKill® or HISTORYKILL or BestPopupKiller

Company, Product, Service, and Domain Names

Do not use or register any TrustSoft trademark, including TrustSoft logos or unregistered names, such as BestPopupKiller, or any potentially confusing variation thereof as part of your company name, trade name, product name, service name, or domain name. Do not place your company name, trademarks, service marks, or product names next to (or combine them with) a TrustSoft product name.

Endorsement or Sponsorship

Do not use any TrustSoft trademark in any manner that expresses or implies TrustSoft's affiliation, sponsorship, endorsement, certification, or approval of any product not sold or provided by TrustSoft. Do not use any TrustSoft trademark in such a manner that it appears TrustSoft is legally associated with your company. You must display your company name more prominently than any TrustSoft trademark on all materials.
